IT IS HEREBY ORDERED that the opinion of the court filed on November 29, 2002, is amended by changing the caption on page 1 so that State of Hawai`i shall become “Plaintiff-Appellant” and Harvey Ababa shall become “Defendant-Appellee” and the caption reads as follows:
The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
